Suburban Card Terms and Conditions of Use

Terms and conditions

These conditions apply to use of the Suburban Card, issued by Suburban Transport Services Pty Ltd (STS) ABN 35 004 539 146. Purchasing or using the Suburban Card means that you accept these conditions. If you let another person use your card, you must advise them that they will be bound by these conditions. You will be liable for any Suburban Card usage if used on account until the account is terminated. The Suburban Card remain at all times the property of STS.

    How and where you can use the Suburban Card

  1. The Suburban Card can only be used to purchase services in Suburban Taxis in metropolitan Adelaide.
  2. The Card can only be used within set limits, which may include
    1.  Fare, daily, weekly, monthly and total financial limits
    2. Number of uses limits.
    3. Time of day limits
  3.  Suburban Cards cannot be redeemed for cash, returned for a refund, be replaced and are not legal tender, credit or debit cards or securities.
  4. Receipts can only be provided at the point of transaction on request.

    5. Validity and Expiry of the Suburban Card

  5. The Suburban Card may have an activation and expiry date set by the account holder. The Card can only be used after the activation date. After the Suburban Card has expired, it is no longer valid. All transactions will be declined.
  6. Any balance that remains on the Suburban Card will not be available for use after the card’s expiry date.


    7. Your responsibility for your Suburban Card

  7. Keep your Suburban Card secure - anyone holding the Suburban Card can use its value to make purchases. The STS client must immediately notify STS in writing if any card/s are lost or stolen.  The client remains liable for any card transaction dated prior to the date of notification.


    8. Errors and Complaints

  8. If you have a query or complaint about the Suburban Card, you may call us on 131008, contact us online at www.Suburbantaxis.com.au or email info@Suburbantaxis.com.au.
  9. We are not liable for the availability, quality or fitness for purpose of any services purchased with the Suburban Card. Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by law, our liability is limited to replacing faulty Suburban Cards.


    10. Termination/Cancellation

  10. We may cancel any Suburban Card, for any reason at any time without notice. If so, we may either provide a refund or a replacement Suburban Card unless we reasonably suspect fraud in relation to a Suburban Card. The Suburban Card remains at all times the property of STS.
  11. Where the Suburban Card is terminated by STS, at the request of the account holder, the account holder will remain liable for all charges incurred on Suburban Cards whether charges relate to journeys carried out or completed before or after the date of the notification of termination of the Suburban Card.


    12. Entire Agreement

  12. These Terms and Conditions of Use shall apply to the exclusion of all agreements, representations and other statements made prior to the use of the Suburban Card and constitute all of the Terms and Conditions of Use which govern the use of the card but subject to any amendments to these Terms and Conditions of Use made in the manner herein described. 


    13. Changes to Terms and Conditions

  13. We can vary or replace these conditions from time to time (including to introduce new fees). The current version of these conditions are available on www.suburbantaxis.com.au/cardtc


    14. Applicable and Proper Law

  14. These Terms and Conditions of Use shall be governed by and construed in accordance with the Laws of the State of South Australia.
  15. The proper law of this agreement is the law of South Australia and the courts of South Australia have jurisdiction to determine any dispute that may arise out of it.


    16. No Waiver

  16. No forbearance delay or failure on the part of STS, to exercise any power or right under these Terms and Conditions of Use shall operate as a waiver of such power or right nor shall any single or partial exercise of any such power or right preclude any further exercise of that or any other power or right.


    17. Liability for Costs

  17. The STS client shall be liable for all legal and recovery costs including but not limited to solicitors fees on a solicitor/client basis and whether arising by virtue of the Local Courts (Civil Claims) Act or such other legislation as may be in force from time to time or otherwise, where such costs and expenses are incurred by STS, in connection with any default of any of the Terms and Conditions of this agreement between STS and the Suburban Card holder.
